Terms of Service

Preamble

These Terms of Service ("Terms") govern your use of Volar and the services available at volardata.com ("Service"), operated by Volar ("we," "us," or "our"). By creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Definitions

  • User — any individual or entity that registers for or accesses the Service.
  • Service — the Volar platform, including the hosted API, dashboard, documentation, and associated tooling available at volardata.com and app.volardata.com.
  • API — the Volar REST and WebSocket interfaces used to access market data and analytics programmatically.
  • Data — Deribit options chain data, computed volatility surfaces, analytics, watermarked Parquet files, and any other market data delivered by the Service.
  • Subscription — a paid or free recurring plan granting access to the Service under specified limits.
  • Tier — the specific subscription level (Sandbox, Pro, or Enterprise) that determines access rights and rate limits.
  • Billing Cadence — for Pro subscriptions, the monthly or annual cycle that determines historical data depth.

2. Account

Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you are not located in a country subject to a US or EU embargo or designated on any OFAC sanctions list, and that you are not otherwise prohibited from using the Service under applicable law.

One Account Per Person or Company

  • Sandbox: single-seat. One account per individual. Sharing Sandbox keys across users is prohibited.
  • Pro: team-of-up-to-five. Up to five named users from a single company may share a Pro subscription, subject to the API-key limits.
  • Enterprise: per signed agreement. Seat counts and license scope are defined in the order form.

Creating duplicate accounts to circumvent rate limits, cadence gates, or download caps is prohibited and grounds for immediate termination without refund.

Account Security

You are responsible for maintaining the confidentiality of your password and API keys. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.


3. Subscriptions and Billing

Self-Serve Billing

Subscriptions are managed self-serve via Stripe. By providing payment details, you authorise Stripe to charge your payment method on a recurring basis according to your selected Tier and Billing Cadence.

Tiers and Pricing

  • Sandbox — €0. 14-day rolling BTC chain data, latest snapshots only. No card required. API access is suspended 30 days after creation unless upgraded. The account itself is not deleted — upgrade at any time to resume access; otherwise delete the account from the dashboard.
  • Pro Monthly — €199 / month. Last 90 days of BTC, ETH, SOL chains, surfaces, analytics, WebSocket, and Parquet files.
  • Pro Annual — €1,990 / year (save €398 vs monthly). Same as Pro Monthly plus the full BTC historical archive (January 2021 through September 2024, 45 months) and continued live forward-collection from April 2026 onward.
  • Enterprise — invoiced, custom pricing. Includes uptime SLA, dedicated support, derivative-data licensing, and team-wide seat allocation. Contact sales.

Billing-Cadence-Gated History

The Pro tier's historical data depth is determined by the Billing Cadence:

  • Pro Monthly subscribers may only query historical Data within a rolling 90-day window. Requests for older dates return HTTP 403 cadence_insufficient.
  • Pro Annual subscribers may query the full historical archive.

Switching from Monthly to Annual unlocks the archive on next subscription renewal. Switching from Annual to Monthly removes archive access at the end of the current billing period.

Cancellation

You may cancel your Subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You retain access until the period ends. After cancellation, you retain rights to Data already downloaded for internal use only — public redistribution remains prohibited indefinitely.

Refunds

Payments are non-refundable except where required by applicable law (e.g., EU consumer rights for digital services purchased in error within 14 days of initial purchase). Partial-month refunds are not provided. Pro Annual subscribers who download a substantive portion of the historical archive within the first 14 days waive their EU statutory withdrawal right by exercising the Service.

Price Changes

We will provide at least 30 days' written notice (via email to your registered address) before changing Subscription prices. Continued use after the notice period constitutes acceptance of the new pricing. Existing subscribers are not affected mid-cycle.


4. Usage Limits and Anti-Abuse

Rate Limits

Each Tier has defined API rate limits and download caps. Exceeding limits results in temporary throttling (HTTP 429). Current limits per Tier:

Anti-Abuse

You may not use the Service to:

  • (a) Circumvent rate limits, cadence gates, or download caps through multiple accounts, credential sharing, or technical workarounds.
  • (b) Probe, scan, or test the vulnerability of the Service or its infrastructure without prior written authorisation.
  • (c) Attempt to access Data or functionality not intended for your Tier or Billing Cadence.
  • (d) Interfere with other users' access to the Service.
  • (e) Use Sandbox access for production trading, paid research output, or any commercial purpose. Sandbox is for format evaluation only.

Watermarking

All Parquet files served via the Service contain embedded per-key watermarks identifying the Subscriber and timestamp of each download. Embedded watermarks are conclusive evidence of the source of any redistributed Data, and Volar may rely on them in enforcement actions without further authentication.

Mass Extraction

Sustained download patterns that exceed reasonable internal-research use (for example, downloading the entire BTC archive in under 60 days on a single Pro Annual subscription) trigger automatic monitoring alerts and may be flagged for review. We reserve the right to throttle, suspend, or terminate accounts exhibiting extraction patterns inconsistent with the licensed use.


5. Data Rights and License

License Grant

Subject to these Terms and payment of applicable fees, Volar grants you a non-exclusive, non-transferable, revocable license to use the Data for the rights specified for your Tier:

Restrictions

You may not, regardless of Tier:

  • (a) Redistribute, resell, sublicense, or publicly republish raw Data to third parties.
  • (b) Use the Data to build a competing market-data service.
  • (c) Reverse-engineer Volar's proprietary computed analytics or surface-fitting algorithms.
  • (d) Strip, alter, or attempt to defeat embedded watermarks.
  • (e) Combine Data with another vendor's data and represent the combined dataset as your own without explicit Enterprise licensing.

Cancel-Then-Retain (Pro Annual)

Pro Annual subscribers who download archival Data and subsequently cancel before renewal retain the right to use the downloaded Data for internal purposes only. Public redistribution, resale, and derivative-data products remain prohibited indefinitely after cancellation. This clause exists because the marquee BTC historical archive is the company's primary commercial asset; the price reflects internal-use licensing, not perpetual redistribution.

Customer Analytics

You retain all rights to derived analytics, models, signals, and research you create using the Data, subject to the license restrictions above. Volar claims no ownership over your derivative work product.


6. Deribit Data Disclaimer

Data is sourced from Deribit's publicly accessible API. Volar is an independent service and is not affiliated with, endorsed by, or in any way officially connected with Deribit. We do not guarantee the completeness, accuracy, timeliness, or fitness of the Data for any purpose. You are solely responsible for verifying Data before making financial, investment, or trading decisions. Nothing in the Service constitutes investment advice.


7. Uptime and SLA

We target the following uptime levels per calendar month:

  • Sandbox — no SLA, best-effort
  • Pro — 99.0%
  • Enterprise — 99.9% (per signed agreement, with service credits)

Downtime caused by third-party providers (Deribit, Cloudflare, Hetzner, Stripe), scheduled maintenance (announced 48h in advance), or force majeure events is excluded from SLA calculations.

Where Enterprise uptime breaches the SLA by more than 0.1% in a calendar month, affected users may request a pro-rata service credit by emailing [email protected] within 15 days of the end of that month. Pro users may report sustained outages but do not receive automatic credits — contact support if downtime materially affected your use.


8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Engage in market manipulation or any activity constituting a financial offence under applicable law.
  • Scrape, harvest, or monitor other users' workspaces or Data.
  • Introduce malware or otherwise harm the Service or its users.

Security researchers who discover vulnerabilities are encouraged to disclose them responsibly to [email protected] before public disclosure.


9. Termination

By You

You may close your account at any time from the dashboard or by emailing [email protected].

By Volar

We may suspend or terminate your account immediately upon: non-payment of fees, material breach of these Terms (including the anti-abuse and watermarking clauses), sanctions or OFAC violation, mass-extraction patterns under §4, or behaviour that causes harm to other users or the Service. No refund is provided for terminations resulting from breach.

Data Deletion

Upon termination, your account data is retained for a 30-day grace period (during which you may request an export), after which it is permanently deleted. See our Privacy Policy for details. Watermarked Data already downloaded remains traceable indefinitely under §4.


10. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

To the maximum extent permitted by applicable law: (a) Volar's total aggregate liability arising out of or related to your use of the Service is capped at the total fees you paid in the 12 months preceding the claim; (b) Volar is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility of such damages.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.


11. Indemnification

Each party agrees to indemnify and hold harmless the other party and its officers, directors, and employees from and against any claims, damages, losses, and costs (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your use of the Service in violation of applicable law; or (c) any claim by a third party relating to your derived analytics or downstream use of the Data.


12. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising under these Terms shall be resolved in the courts of Bucharest, Romania, and both parties submit to the exclusive jurisdiction of those courts. Nothing in this section limits a consumer's right under their local jurisdiction to bring proceedings in their country of habitual residence where applicable consumer-protection law so provides.


13. Changes to These Terms

We may update these Terms at any time. We will provide at least 30 days' notice via email before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
